In October of 2018, we opened the Capital § 2255 Unit of our office. The first of its kind in the country, the Unit is devoted exclusively to the representation of persons convicted and sentenced to death in the federal system whose convictions and death sentences have been affirmed on direct appeal.
Almost all of the federal death row prisoners in the country are housed at the United States Penitentiary in Terre Haute which is 75 miles from our offices in Indianapolis. The litigation of a capital case requires an intense level of preparation against a clock. The attorneys must review every piece of the underlying criminal case, interview witnesses, and sometimes reinvestigate. Our clients are an important part of this process. Proximity to our death row clients makes it much easier for us to visit and talk with them about their case on a regular basis. Frequent visitation of those who are awaiting execution is an important component of developing a relationship of trust with our clients, an integral part of death penalty work.
